MLS Questions Eligibility of Attorney General for Senior Counsel Honor
The Senior Counsel designation is highly revered within Malawi's legal fraternity, conferred upon seasoned practitioners for distinguished service.
BLANTYRE, MALAWI - The Malawi Law Society has raised concerns over the eligibility of Attorney General Thabo Chakaka Nyirenda for the prestigious Senior Counsel honor, citing potential violations of legal requirements outlined in the Legal Education and Legal Practitioners Act of 2018, writes Winston Mwale.
In a letter dated August 24th, 2024, addressed to the Solicitor General, the society questioned whether Nyirenda meets the mandated 15 years of practice before being conferred as Senior Counsel.
Records show he was admitted to the Bar in 2008 and applied for the honor in July 2022, falling short of the requirement.
The society also flagged information suggesting more than three lawyers would receive Senior Counsel status on August 26th, exceeding the limit prescribed in the Act.
"The Executive Committee considers that these are weighty legal matters and makes the recommendation for further reflection in terms of the Society's mandate...with a view to preserving the integrity of the profession and honor attributed to the status of Senior Counsel," stated Patrick Gray Mpaka, MLS Chairman.
The letter urgently seeks clarification from the Ministry of Justice on the way forward regarding the conferments.
Conferment as Senior Counsel is among the highest honors for legal practitioners in Malawi, recognizing distinguished service.
