CHIMDIMA CASE MOVES TO HDU ONCE AGAIN
Mr. Sephas Chimdima told the court that he heard that on the radio, so if he was wrong, the radio, in his words, 'lied.'
The case against Dean Van Schalkwyk was, once again, transferred to the high dependency unit of Kamuzu Central Hospital on Friday afternoon.
The defence lawyer, Mr. George Mwale, and the two prosecutors, Happy Mkandawire and Fatuma Silungwe, were all dressed as if they were in a hospital theatre.
Mr. George Mwale, the defence counsel, continued his cross-examination, which lasted nearly an hour.
Among other things, the defence counsel asked the victim if he was aware that hospital records showed he was brought to Kamuzu Central Hospital around 7 p.m.
Mr. Sephas Chimdima told the court that he heard that on the radio, so if he was wrong, the radio, in his words, 'lied.'
Mr. Chimdima stated that all he knows is that Mr. Dean Van Scavo wanted him injured and that what he did that day by shielding him was not assigned that he wanted to protect him.
After disagreeing on this and other issues, Mr. George Mwale, the defence counsel, told the court that a full medical report on the victim, particularly his psychological fitness, should be produced before the case continues.
According to Mr. Mwale, in the interest of justice, the court should allow the victim to fully recover. He also requested that the court visit the accident site to fully appreciate the setting.
Meanwhile, the victim's lawyer says she will leave on Monday for much-needed plastic surgery in South Africa.
The case has been adjourned until September 10, 2010, by Chief Resident Magistrate Chifundo Kachale.
He also stated that he hopes to have access to all medical reports.
